Technical Student Visas
Individuals who which to pursue full-time vocational studies are admitted to the United States through M visas. The M-1 category includes students in vocational or technical programs, as well as other types of non-academic programs. Vocational student visas allow applicants to come to the U.S. to attend non-academic schools. Like trade schools or practical training schools. Students holding vocational student visas are permitted to remain in the U.S. as long as they continue the vocational program on a full-time basis. Vocational Students are allowed to engage in Optional Practical Training (OPT), which is temporary employment that is directly related to the student’s area of study, for 1 month for every 4 months of study.
In order to be eligible for a vocational student visa, foreign applicants must be accepted by a vocational or non-academic institution in the U.S. The applicant must then apply for the visa prior to their entry and show that the purpose of their stay is for full-time studies, consisting of 18 hours or more of study per week. Students also have to provide proof of sufficient funds to cover the costs of schooling and living expenses and maintain their residence abroad while showing proof of binding ties to ensure their return home.
As a vocational student, the person may remain in the U.S. for 1 year with further extensions up to 3 years as a full-time student. Once full-time studies are completed, the applicant may remain in the US for 30 days to prepare for departure. The applicant’s spouse and unmarried children under 21 years of age may accompany the applicant to the US upon approval of an M-2 visa. The applicant’s spouse may not accept employment or engage in study, but the applicant’s children may attend primary and secondary school during their stay in the US.
