K-1 Fiancé Visa 

If you are a citizen of the United States and are planning to marry someone who is not a U.S. citizen, your fiancé(e) will need a visa to enter the United States.  Specifically, your fiancé will need a K-1 visa, which will allow you to get married and then pursue permanent residency.  In order for a person to be eligible for a K-1 visa, the marriage must be legally possible according to state laws in the state where the marriage will take place.  The two parties must have met in person within the past two years, except for situations excused by the U.S. Citizenship & Immigration Services (USCIS). 

If you are an American citizen and you want your foreign fiancé(e) to travel to the U.S. to marry you and live with you in the United States, you must first file a Petition for Alien Fiancé(e).  This is only the first of many steps that will need to be taken to obtain a visa for your fiancé, and Atlanta immigration attorney Kenneth Muhammad can help you through this process.  As your lawyer, Mr. Muhammad will make sure you and your fiancé have all the proper information needed to embark on this process and will make sure you have all the following requirements:

  • A passport valid for travel to the United States and with a validity date at least six months beyond the applicant's intended period of stay in the United States (unless country-specific agreements provide exemptions).
  • Birth certificate
  • Divorce or death certificate of any previous spouse for both the applicant and the petitioner
  • Police certificate from all places lived since age 16
  • Medical examination (vaccinations are optional, see below)
  • Evidence of financial support (Form I-134, Affidavit of Support may be requested.)
  • Two Nonimmigrant Visa Applications, Form DS-156 (A Form DS-156, prepared in duplicate.)
  • One Nonimmigrant Fiancé(e) Visa Application, Form DS-156K 
  • Two nonimmigrant visa photos (each two inches 50 X 50 mm square, showing full face, against a light background)
  • Evidence of a fiancé relationship
  • Payment of fees
